Justice Department's Surprising Move on New York Times Subpoenas

Lawyers with the Department of Justice on Thursday agreed to unilaterally withdraw a series of subpoenas that sought to compel New York Times journalists to testify about their sources and to access their phone records. U.S. District Judge Arun Subramanian said he would quash the subpoenas if the Department of Justice refused to withdraw them. "It's a matter of basic compliance with the law," Judge Subramanian said. Attorneys for the New York Times were in court Thursday to fight a series of grand jury subpoenas they allege were an attempt to retaliate against and intimidate reporters whose work angered President Donald Trump. Lawyers for the newspaper had asked the judge to quash the subpoenas, which sought to compel the journalists to testify about their sources, as well as access the phone records of the reporters and some of their family members. Sean Buckley, the chief counsel to the U.S. attorney for the Southern District of New York, said that prosecutors would return to the judge if they decide to seek new subpoenas in the future. "Upon further consideration, the government is prepared unilaterally to withdraw the subpoenas at this time," he said. In this May 20, 2026, file photo, The New York Times building is shown in New York.Michael M. Subramanian asked. "Subpoenas are the last step, not the first step." Federal prosecutors also admitted to a series of mistakes and "imprecise" wording that led the DOJ to seek additional subpoenas, even after lawyers for the New York Times raised concerns about the legality of the initial subpoenas. "When you see something like this, if this were a civil proceedin. ... what I would normally do is ask the parties to show cause why sanctions shouldn't issue or steps shouldn't be taken with respect to the incorrect statements and misstatements," Subramanian said about the errors and oversights made by the Department of Justice.Lawyers for the New York Times criticized the actions of the Justice Department, saying the "record is replete with bad faith." Popular ReadsThe Department of Justice defended the subpoenas in court filings, arguing they were trying to identify if government employees are leaking classified information that impacts national security. "The above-referenced articles presented a substantial national security concern, including because they indicated potential leaks of classified or national defense information that appeared to have been provided to the Times when the President of the United States, senior officials, and reporters were flying in foreign airspace during a time of hostilities with a foreign adversary that has made clear its intent to harm the President and U.S. interests," wrote Sean Buckley, the Deputy United States Attorney for the Southern District of New York. However, lawyers for the New York Times argued that the subpoenas were unlawful and unconstitutional because they "were issued in a bad faith effort to harass," intimidate and retaliate against the newspaper, which they said, "has been a particular lightning rod for the President's ire." "Every indication supports the conclusion that the Administration issued the Subpoenas because the reporting enraged the President and embarrassed him by resurfacing and reinforcing criticism about his acceptance of a jet from a foreign government and his insistence on quickly retrofitting it for use as Air Force One," the Times attorneys wrote. The Qatari royal family donated the $400 million Boeing 747-8 to the United States last year, and the Air Force had estimated it would cost less than $400 million to retrofit the plane. It's unclear how much money has been spent on the plane so far, and the plane is expected to undergo further upgrades.Shortly before Trump leaves office, the ownership of the plane is expected to be transferred to the Donald J. Trump Presidential Library Foundation, so Trump can continue using the luxury aircraft. Lawyers for the New York Times also argued that the subpoenas violate the basic journalistic protections affirmed by the 2nd U.S. Circuit Court of Appeals, which established a three-part test to evaluate if a journalist must disclose their sources. Under that test, prosecutors would need to demonstrate that they have exhausted all other options to get the information. "The timing compels the conclusion that the Government did not even try to comply with its own regulations governing media subpoenas," lawyers for the New York Times wrote in a court filing, highlighting that the subpoenas were served within a day of the investigation beginning. "In that brief period, the Government plainly did not have time to commence, much less conduct, an investigation of any suspected leak of classified or National Defense Information." The Times has also accused the Department of Justice of violating their own guidelines for notifying reporters about the subpoenas, as well as issuing another subpoena after the outlet filed its motion to quash the initial subpoenas. According to a court filing last week, the Department of Justice served at least two subpoenas to phone providers after the New York Times raised concerns about the lawfulness of the first subpoenas.   Federal prosecutors deny that they violated DOJ policies, failed to carry out initial investigative steps, or lack a legal basis for the probe. "We value and appreciate the important role that the press plays in this country, but DOJ also plays an important role to make sure that the people entrusted with our nation's secrets do what they're supposed to do with that information, which means not sharing classified information," a Department of Justice spokesperson said earlier this month.

The White House is quietly preparing for a Democratic takeover of the House by hiring lawyers to fend off a wave of legal challenges that could cripple the final two years of President Donald Trump’s time in office.The preparations illustrate how the White House is privately preparing for the possibility that Democrats will regain at least one chamber of Congress in November, even as Republicans express confidence in public, according to people close to the administration.A Democratic House next year could be reminiscent of 2018 fights that included impeachment inquiries of the president and multiple investigations into his inner circle.Michael Williams, who served in White House roles in President Donald Trump’s first term and was deputy general counsel for the Trump-Vance Inaugural Committee, said staff is already preparing for another impeachment push even as Trump sets a broader strategy for dealing with Democrats.“They’re ready for that eventuality,” Williams told Bloomberg Government. “I don’t think they’re ready to concede that that’s the likely outcome, but they’re certainly prepared in that event.”Advertisement Emma Doyle, former chief of staff at the Office of Management and Budget during Trump’s first term who later worked in the West Wing, said the administration is already hiring experienced lawyers to help prepare officials for impeachment, as she did in the first term.The return of advisers Jason Miller and Johnny DeStefano strengthens the White House for those fights, Doyle said, along with staff such as Mark Paoletta, the OMB general counsel who worked on impeachment defense in the first term.Miller and DeStefano rejoined the White House last month to work on midterm strategy.However, Democrats are facing their own problems.House Minority Leader Hakeem Jeffries (D-N.Y.) may find himself caught in the very blue wave he hopes to ride into power this November.More and more Democratic candidates are telling Axios that they can’t promise to support his leadership.It’s a big change from Jeffries’ once “untouchable” position in the Democratic Party just a few years ago. This could mean his path to the speakership will be harder than people thought.Jeffries and his supporters say they aren’t worried at all about a mass defection. They point out that he hasn’t lost a Democratic vote in 20 speakers’ ballots, even though he is in the minority.However, this group of new candidates could potentially be the first challenge to the previously unyielding support.A group of viable candidates has made it clear that voting for Jeffries as speaker is not a given if the Democrats win the House.Axios reported that more than 80 Democratic House candidates across the country were either not sure if they would support Jeffries’ leadership or were completely against it.Since then, things have only gotten worse for him.The tension was on display in New Jersey’s 7th Congressional District. Democrat nominee Rebecca Bennett, who likely needs to beat Rep. Tom Kean (R-NJ) if Democrats have any shot at the majority, refused to commit to voting for Jeffries before her primary win.Likewise, Iowa’s 1st congressional Democratic nominee Christina Bohannan is also noncommittal, merely responding “I don’t know yet. I haven’t made that decision,” when asked by Punchbowl News if she would support Jeffries.“I want to get elected first,” she continued.The nonpartisan Cook Political Report has classified both Bohannan and Bennett’s districts as toss-ups.Republicans currently hold both seats.Montana’s 1st congressional Democratic nominee Sam Forstag echoed similar sentiments as Bohannan.Forstag sits in a seat labeled “likely Republican,” but has no incumbent running.Mai Vang, the leading progressive primary challenger to Rep. Doris Matsui (D-Calif.), previously said she would “support the person that my future colleagues elect as our leader.”But in an unprompted statement last week, she told Axios: “The Democratic Party and its leadership—Chuck Schumer and Hakeem Jeffries—have failed to mobilize meaningful opposition to Trump’s illegal war and their silence as AIPAC and corporations flood Congressional primaries with millions of dollars is deafening.”“I cannot support this kind of leadership,” Vang said. “If we want to defeat Trump and rebuild trust with working Americans, we need new leadership and a new direction.”“Most Democrats agree that he’s been failing to meet the moment,” said Adam Hamawy, a candidate in New Jersey’s 12th district, saying he is “looking for someone that’s gonna stand up to the administration.”When asked if she would support Jeffries’ leadership, Claire Valdez, a New York State Assembly member who is running to replace retiring Rep.
